Mr. Baxter was asked concerning Janis Johnson’s relationship with Alain Kartuzinski. He replied, “To the best of my knowledge, she had some medical training and she was, to the best of my knowledge, in... in communication with Alain Kartuzinski. I honestly don’t know what her medical training is” (page 55, lines 2-8, deposition transcript). .

On April 10, 1997, Heather Noelle Petzold testified at deposition as the result of a State Attorney’s subpoena.

Ms. Petzold testified that she saw Janis Johnson and David Houghton in Lisa’s room (page 22, lines 1-11, deposition transcript).

Ms. Petzold testified that she personally delivered a report concerning Lisa to Alain Kartuzinski (page 32, lines 9-16, deposition transcript).

Ms. Petzold said she wrote a report concerning Lisa’s deteriorating condition on 12-5-95 and delivered it to Alain Kartuzinski’s office (page 33, lines 4-25, deposition transcript).

Ms. Petzold testified that she witnessed Janis Johnson administer a shot to Lisa (page 47, lines 15-25, deposition transcript).

Ms. Petzold was asked by SA Strope, “Who was number one in charge of this watch?” She replied “Alain” (page 60, lines 24-25, deposition transcript).

Ms. Petzold further testified that decisions for the most part concerning Lisa had to be cleared through Alain Kartuzinski (page 31, lines 1-21, deposition transcript).

Ms. Petzold testified that Alain Kartuzinski showed up at Lisa’s room, checking on her, early in the watch (page 70, lines 1-22, deposition transcript).

Ms. Petzold testified that Alain Kartuzinski was in charge of Lisa’s mental condition (page 73, lines 16-25, deposition transcript).

Ms. Petzold was asked who was in charge of Lisa’s medical condition and she replied “But whoever it would be, it would be in coordination with Alain, and probably, I could only say probably, Janis” (page 74,Iines 14-22, deposition transcript).

Ms. Petzold was then asked “But, she (Janis Johnson) couldn’t do anything without Atain?” and she replied “Right” (page 74, lines 23-24, deposition transcript).

Ms. Petzold testified that either Alain Kartuzinski or Janis Johnson could have made the decision to end the watch and take Lisa to a hospital (page 75, lines 1-10, deposition transcript).
